RECENT CASES @ THE JACOBS LAW


  • BUSINESS / CORPORATE LAW: 
    • where U.S.-based client (distributor of alcoholic beverages) required an Exclusive Distribution Agreement, including provisions for exclusive importer status (Master Importer) for a transaction with its Canadian-based supplier / manufacturer. Client also required assistance with an Application for Basic Permit Under the Federal Alcohol Administration Act, Application for Certificate of Label / Bottle Approval, and various other documentation for the importation of alcoholic beverages into the U.S.
    • where client requires Articles of Incorporation, Bylaws and state & federal filings for a corporate entity in Massachusetts and the European Union which will conduct cross-border transactions with itself and other corporate entities and organizations. Includes internal corporate policies and initial annual report.
    • where out-of-state clients formed a Massachusetts business entity with Articles of Organization, By-laws, and Operating Agreement and have requested assistance filing for S-Corp status.
    • where two separate and independent Massachusetts business entities have sought legal counsel to draft a package of documents 1) to provide to customers of a home improvement business at the time of agreement and upon completion of a project and 2) to provide to customers of a vehicle towing and repair company for repair estimates, supplemental work, storage fees, and liens on vehicles for unpaid work.
  • CONTRACT DISPUTES: 
    • for breach of contract between a business / tradesman and a condominium association where tradesman was contracted to perform work and then condo association cancelled the job at the last minute.
    • for breach of contract by an insurer, due to insurer's bad faith denial of insurance coverage
  • NON-PROFIT INCORPORATION: 
    • where client requires state & federal incorporation documents for a non-profit corporation, including a completed IRS 1023 Form and Conflicts of Interest, Fundraising, Non-Disclosure and other internal corporate policies
  • CRIMINAL APPEALS:
    • where the stop of client's vehicle was justified by his alleged violation of a Massachusetts General Laws statute, and led to charges of OUI 3rd Offense, client's attorney filed Motion to Suppress. Client's Motion to Suppress was granted, but Commonwealth has filed an Interlocutory Appeal. The Jacobs Law presently represents the defendant in opposition to the Commonwealth's appeal to the Massachusetts Appeals Court. Oral Arguments pending;
    • where client was charged with a crime that constituted a violation of his probation terms, and was subsequently jailed. The Jacobs Law filed an appeal to the Massachusetts Appeals Court which was denied.
  • MEDICAL MALPRACTICE:
    • Young woman was admitted to a hospital emergency room with an ectopic pregnancy, and required surgery. Surgeon removed the wrong fallopian tube and the problem persisted, eventually requiring removal of the second and final tube
    • Middle-Aged man run-over by a car presented at a local hospital emergency room with possible internal injuries. ER physicians and staff failed to diagnose a hip fracture, ruptured spleen and internal bleeding.
  • PREMISES LIABILITY:
    • client fell through negligently constructed and maintained stairwell and suffered disabling physical injuries
    • negligent installation of water heating unit cause client's 2nd and 3rd degree burns
  • ESTATE PLANNING packages for:
    • family of 4 with minor children
    • elderly couple with several grown children
    • elderly widow whose husband recently passed away
    • a single woman with 2 minor children and significant assets
  • WORKER'S COMPENSATION:
    • where client settled with insurance company, but now the insurance company refuses to cover ongoing medical expenses
    • where insurance company refuses to pay medical bills and denied coverage for a key surgery
    • where insurer denied payment for client-employee's prescription medication
  • SOCIAL SECURITY DISABILITY:
    •  where client suffered a severe physical and mental injury as the result of a freak accident and cannot return to regular employment
  • CRIMINAL DEFENSE:
    • armed home invasion
    • assault and battery with a deadly weapon
    • operating after suspension of license
    • drug possession
    • driving while under the influence
    • leaving the scene of an accident with property damage
    • permitting an unlicensed individual to operate a motor vehicle
  • CHILD CUSTODY:
    • client's ex has filed for a modification of custody order
    • child custody trial 
    • Complaint for Modification due to ex-spouse's refusal to permit previously agreed upon visitation with children
  • DIVORCE:
    • client received divorce and was not required to assume any of the nearly $200,000.00 in marital debts
    • where client with one child obtained a divorce and received full ownership of the marital home, less than half the marital debts, and sole physical / joint legal custody of the minor child.
    • where client sought and obtained an annulment of the marriage
  • MOTOR VEHICLE ACCIDENTS: 
    • client's SUV was struck head-on by a low-riding vehicle and flipped over causing serious injuries
    • client was struck and killed in a highway accident involving multiple vehicles
    • client was a pedestrian in a residential neighborhood and was struck by a motor vehicle
    • client's vehicle was "t-boned" by another vehicle in the middle of an intersection.
